AS MEMBER NATIONS OF THE United INDEPENDENT NATIONS;
We Agree that all nations deserve the utmost freedom and sovereignty within the boarders of their own nation. Bearing that in mind, we create this Charter as a pact between nations. A Pact of Peace and Friendship. One that promotes the freedom of Citizens within each member nation, and will always support a state's national sovereignty.
ARTICLE I - MEMBERSHIP;
A. Defining Member Nation, as any nation residing within the United Independent Nations (or UIN).
B. Unless otherwise specified within this charter, no nation will be forced to make certain legislation, nor any legislation be banned.
C. Full Member Nations shall be any nation residing within the UIN, shall be a World Assembly member, and shall maintain an account on the offsite UIN forum.
D. Special exceptions may be made for nations unable to join the World Assembly due to previous infractions. Exceptions my only be approved by the unanimous consent of the combined Justices as well as the Representative.
E. Nations who do not meet the full criteria to become a Member Nation shall be henceforth known as "Observer Nations".
F. Observer Nations are still entitled to the rights and protections outlined in the UIN Charter, but are restricted from voting rights and are not allowed to run for office.
ARTICLE II - EXECUTIVE;
A. The Office of Representative will be elected every sixty(60) days and shall not serve more than two(2) consecutive terms.
B. The Representative will serve as head executive of the UIN.
C. The Representative will serve as World Assembly Delegate for the UIN.
D. In order to be eligible for the office, The Nation must be a Member Nation, and must be a member of the World Assembly.
E. The Representative is responsible for the approval and veto of resolutions drafted by the Congress.
F. Any action of the Representative may be vetoed by a Member Nations Vote in which the votes for a veto surpass the amount of votes against.
G. The candidate with the closest number of votes to the Representative at the end of an election shall become Vice Representative, and shall succeed the Representative in the event that the Representative is removed from office.
H. The Representative shall create a cabinet of no more than 4 personal advisers, each with specific roles. The creation of cabinet positions, as well as appointing members to fill those positions, must be approved by a majority vote of Congress.
I. The Representative may only declare war against another region or organization, and only with the approving vote of 3/4 of voting Congress members.
ARTICLE III - LEGISLATIVE;
A. All Full Member Nations of the UIN are members of Congress, except for those members serving as Justices or as the Representative.
B. Congress shall pass no laws, resolutions, or otherwise binding legislation blocking membership in any shape or form to Full Member Nations.
C. Congress may pass resolutions of self-government, and such procedural rulings shall not extend beyond the duties of Congress.
D. It is the duty of Congress to debate, discuss, and draft laws, resolutions and otherwise binding legislation for the consideration of the Representative.
E. Should the Representative veto legislation, Congress shall override any veto with at least a 3/4 vote in favor of passing said legislation.
F. Congress has the authority to convene in order to impeach the Representative for dereliction of duty, crimes against the UIN, or any other actions that deem the Representative unfit to serve.
G. Any final vote of Congress shall only consider the actual votes counted by the closing of the voting period.
H. The Vice Representative shall preside over Congress and is responsible for keeping order.
ARTICLE IV - JUDICIAL;
A. Justices of the UIN shall be appointed by the Representative.
B. Appointed Justices must receive a majority vote of acceptance from Congress in order to take office.
C. There shall be three(3) Justices at all times.
D. The longest serving Justice shall serve as the Chief Justice. If there is no difference in time, the Representative may choose a Justice to serve as Chief Justice.
E. Justices are responsible for deciding the guilt or innocence of parties brought to trial. Acts of treason, espionage, or any other crimes committed with the intent of causing harm to the UIN require a unanimous decision from the Justices and will result in the immediate ejection and ban of the nation from the UIN and the forums.
F. Crimes that harm the UIN that only receive two(2) votes of guilt may still punishment.
G. Justices shall determine the guilt or innocence of any other crimes, not immediately deemed harmful against the UIN, by a simple majority of 2 votes.
H. In all cases not already outlined in part E., the Chief Justice shall decide the punishment to be served by nations found guilty of crimes.
I. In the event that the Representative is impeached by Congress, a unanimous decision must be reached by the Justices to remove the Representative from office. The Representative shall be removed from office, and the Chief Justice shall determine further punishment, if necessary, in a manner describe in previous sections of this article.
ARTICLE V - ELECTION OF THE REPRESENTATIVE;
A. One week before the end of the Representative's term, an Official Vote will be held for the position of Representative.
B. All votes must be submitted by Full Member Nations via an election thread to be created on the UIN's offsite forum.
C. Voting will take place of no more than seven(7) days, and no less than three(3) days.
D. All votes after said period are to be considered invalid.
ARTICLE VI - SOCIAL CONTRACT;
A. All nations residing in the UIN hereby agree to a Social Contract.
B. No nation shall violate any NationStates mandates regarding communications and behavior, including but not limited to abusive language, racism, hate speech, and spam.
C. No nation shall infringe upon another nation's right of sovereignty.
D. No nation shall act in a way that shall cause harm to any members of UIN, or any institution therein.
E. No law shall be passed that infringes upon a nation's freedom of speech.
F. All nations shall reserve the right to a fair trial.
Article VII;
A. The UIN will consider an attack on a Member Nation as an attack on all Member Nations, and will respond accordingly.
B. A Standardized system of Caution and War will be used, like so;
1. No Immediate Threat.
2. Possible Threat.
3. Caution.
4. Immediate Threat.
5. Large Threat.
